Simple Separation provides upfront and fixed fees for Divorce. Sole Divorce Applications are priced from $699* and Joint Applications from $499* (pricing is dependent on type of application and whether there are children of the marriage u18).

STEP 1 : APPLY

Complete Simple Separation online divorce questionnaire

STEP 2 : PREPARE

Once payment is processed, Simple Separation will prepare your Application for Divorce,

ensuring all questions are answered correctly, to give you higher chance of success.

STEP 3 : SIGN

Signing of the application before a witness is required (Justice of the Peace or other qualified witness)

STEP 4 : FILE

Our legal practitioner will file your application with the court

STEP 5 : SERVE

For sole divorce applications only, we arrange to serve sealed copy of the Application for Divorce on your spouse

STEP 6 : ATTEND HEARING

If there are children of the marriage under 18, we will attend the divorce hearing on your behalf.

STEP 7 : OUTCOME

If your application is successful, the Court will grant a Divorce Order.

How much does a divorce cost?

Simple Separation provides upfront and fixed fees for Divorce. Sole Divorce Applications are priced from $699 and Joint Applications from $499.

Simple Separation offers pricing at a fraction of the cost of traditional law firms. Here are some fees you need to be aware of.

  • There is a court ordered filing fee of $930 (there is a reduced filing fee of $310 for concession card holders)

  • There is a cost of obtaining a marriage certificate (if you can’t find it), approximately $60.

  • There is cost of serving the divorce application on your spouse, unless you jointly apply

  • Generally a solicitor will charge legal fees between $2,500 to $6,000 to undertake all the necessary steps to assist you. Why pay more, when Simple Separation can provide you with price that is a fraction of the cost of legal fees.

Simple Separation assists parties with Sole and Joint Divorce applications, with or without children. Before you start your application it is important to understand whether to file a sole or joint application, as there are different obligations in either case. Simple Separation recommends you deal with your property settlement first before getting a divorce.

Here are some basic requirements when seeking to apply for a divorce.

  1. A divorce is only required at the ending of the relationship where a marriage has taken place. This marriage could be in Australia or overseas.

  2. To be eligible for a divorce your marriage certificate will be required (if in a foreign language there will need to be a certificate of translation lodged with the documents).

  3. If you are an Australian citizen or not, if you live in Australia and it is your intention to reside in Australia, that is a sufficient link to make your application for divorce in Australia, rather than the country of your marriage.

  4. To be able to get divorced, you need to show that your marriage has ‘irretrievably broken down’. This is demonstrated by being separated for 12 months or more, and there being no likelihood of the relationship resuming.

Joint Applications

For joint applications, whether there are children or not under the age of 18, the court is usually prepared to deal with your divorce application. This means though the court will read your paperwork and if satisfied all is in order, they will make your decree of divorce. Please note that if there are children under the age of 18, the court will closely inspect arrangements for the children. Provided the court is happy with the details in your application they will order the divorce to progress. If there are technical issues or gaps in the paperwork or the court is simply not satisfied with the children’s arrangements, the divorce application will be adjourned to a later date. to enable you to file further affidavit material.

Sole Applications

Court requires the applicant spouse or their legal representative appear at the hearing. Your former spouse does not need to attend the court hearing.

Part of the Simple Separation divorce service is that our legal practitioners will attend all hearings on behalf of our clients. if the children are under 18, the team at Simple Separation will prepare a short affidavit for you to sign which will indicate whether there are any changes in circumstances of the parties and in particular with respect to arrangements for the children from the time of filing your application up until the hearing date.

*In Australia, you have until 12 months from the date of your divorce to finalise your property settlement. Simple Separation recommends you deal with your property settlement first before getting a divorce.
